ALGEMENE VERKOOPVOORWAARDEN

Inleiding
De Site wordt uitgegeven door DIGITAL GLOBAL PASS (hierna “DGP” genoemd) waarvan de
gegevens weergegeven worden in het “Info Uitgever en Klantendienst”.
De toegang tot de diensten die aangeboden worden op de website FUZEFORGE:
http://www.fuzeforge.be/ (hierna de “website” genoemd) veronderstelt de onvoorwaardelijke
aanvaarding van deze bepalingen (hierna “AV” genoemd).
Alle verbintenissen van DGP inzake de bescherming van persoonsgegevens, de rechten waarover u
beschikt ten aanzien daarvan en de voorwaarden waaronder uw persoonsgegevens worden
verzameld, verwerkt, bewaard en gearchiveerd, zijn beschikbaar op de website:

De AVV zijn opgesteld in het Frans en online beschikbaar via de website. DGP behoudt zich het
recht voor haar AVV te wijzigen.
ARTIKEL 0: DEFINITIES
AVV: duidt deze algemene verkoopvoorwaarden.
IP: duidt op een internetprovider.
DGP: duidt op de vennootschap DIGITAL GLOBAL PASS.
Abonnement: dit is de afsluiting van het week- of maandabonnement met een
minimumduur van een week of een maand (afhankelijk van de gekozen
formule) waarmee u gebruik kunt maken van de Dienst en onbeperkt
toegang hebt tot de content in het kader van het abonnement. Het
abonnement wordt stilzwijgend verlengd voor opeenvolgende periodes van
een week of een maand, naargelang het geval tot de opzegging ervan door
de Gebruiker volgens de in de AVV vermelde voorwaarden.
Dienstverlening: duidt op de dienst van door DGP aan de Gebruikers aangeboden content die
toegankelijk is in het kader van de inschrijving op een abonnement.
Site : dit is de website en/of promotiepagina’s (“landing page”) uitgegeven door
DGP waarop de content wordt voorgesteld.
Promotiedrager(s) : dit zijn de dragers waarop DGP haar dienst promoot. Dit kunnen o.a.
nieuwsbrieven, websites, webpagina’s, mobiele banners zijn.
Apparatuur: duidt op vaste en mobiele apparatuur.
Vaste apparatuur: omvat iedere vaste, bestaande of toekomstige apparatuur die verbonden is
met een radio-telecommunicatienetwerk, met inbegrip van voornamelijk
computers (met name van het type PC, MAC), verbonden compatibele Tv’s
die toegang verschaffen tot de Dienst.
Mobiele apparatuur: omvat iedere bestaande of toekomstige mobiele apparatuur, die verbonden
is met een radio-telecommunicatienetwerk, met inbegrip van voornamelijk
compatibele smartphones, verbonden tablets die toegang bieden tot de
Dienst.

Gebruiker(s) : de persoon of personen die heeft of hebben ingeschreven op de Dienst.
ARTIKEL 1: Doel
Deze AVV hebben tot doel de voorwaarden te regelen waaronder de Dienst wordt aangeboden aan
de Gebruikers, waarbij deze Dienst de Gebruikers in staat stelt content te streamen op vaste en
mobiele apparatuur. De door DGP aangeboden dienst is een dienst die toegankelijk is door het
afsluiten van een abonnement. De inschrijving op dit abonnement kan plaatsvinden via de website
http://www.fuzeforge.be/, de promotiepagina’s of via de Applicaties. Het abonnement wordt aan
de gebruiker gefactureerd via de betaaloplossingen van de mobiele operator of door afschrijving
van zijn of haar creditcard.
Het loutere gebruik van de Dienst veronderstelt de volstrekte aanvaarding van deze AV door de
Gebruiker.
ARTIKEL 2: VOORWAARDEN VOOR TOEGANG TOT DE DIENST
2.1. De toegang tot en het gebruik van de Dienst zijn voorbehouden aan meerderjarige natuurlijke
personen.
Indien de Gebruiker een minderjarige natuurlijke persoon is, verklaart en erkent hij de
voorafgaande toestemming van zijn ouders of van de houder(s) van de ouderlijke macht te hebben
verkregen om zich in te schrijven en de Dienst te gebruiken. De houder(s) van het ouderlijk gezag
heeft/hebben ermee ingestemd dat hij/zij garant staat/staan voor de naleving door de Gebruiker
van alle bepalingen van deze AVV. De houder(s) van het ouderlijk gezag wordt (worden) verzocht
toe te zien op het gebruik dat hun kinderen maken van de toegang tot de Dienst en er rekening
mee te houden dat de Dienst ontworpen is om een breed publiek te bereiken. Als wettelijke
vertegenwoordiger valt het onder de verantwoordelijkheid van de ouders om te bepalen welke
Dienst al dan niet geschikt is voor hun kind(eren) en om toe te zien op het gebruik daarvan.
Voor gebruik vanaf de werkplek moet de Gebruiker toestemming vragen aan zijn werkgever of zijn
hiërarchische manager.
2.2. Om toegang te krijgen tot de Dienst moet de Gebruiker met name:
